Certification trademark rules of use of MTNS MADE logo

1. Owner and approved certifier

In response to industry demand for a collaborative approach to branding, Blue Mountains Economic Enterprise (BMEE), and subsequently Blue Mountains City Council (BMCC), created MTNS MADE as the cultural identity for MTNS MADE members in the Blue Mountains. The MTNS MADE brand is designed to promote the Blue Mountains as home to world-class creative talent and to attract new clients and investors to the region. BMCC is the owner of the MTNS MADE certification trademark, hereafter called the trademark logo. The Creative Industries project officer of BMCC (‘Project Officer’) will be the authorised certifier, who will assess whether the goods and/or services meets the certification requirements.

2. Certification requirements

The certification requirements that an applicant must meet to utilise the trademark logo are:

  1. The applicant must be operating their business within the Blue Mountains LGA.
  2. The applicant must be a current and continuing paid-up member of MTNS MADE.
  3. The applicant must have a registered ABN.
  4. The goods or services created and/or provided by the applicant must fall within the defined scope of the creative industries sector. The creative industries are defined as “those sectors which specialise in the use of creative talent for commercial purposes” (NESTA, 2013). The following broad industry-compliant categories include:
  • Advertising and marketing
  • Artisanal food and beverage products
  • Built environment
  • Creative Makers (handicraft, jewellery, furniture, design pieces etc.)
  • Design (including fashion, industrial and graphic design)
  • Performing Arts
  • Publishing
  • Radio, podcasting, social media
  • Screen (television, film and electronic games)
  • Sound and music
  • Software development and interactive content
  • Textiles production, pattern-making and related activities
  • Visual Arts

3. Application of the logo

If the applicant meets the certification requirements:

  1. The project officer will provide a simple usage agreement to the applicant, now known as the logo user. The logo user and project officer will both sign the agreement.
  2. The project officer will then provide the MTNS MADE Logo (trademark logo) and the MTNS MADE Industry Manual (Style Guide) to the logo user.
  3. The logo user must read, understand and comply with the Style Guide before applying the trademark logo to their products and/or service.
  4. The logo user will submit to the project officer a sample of the trademark logo material to be used on the products and/or service of their business. The trademark logo material must comply with the requirements of the Style Guide.
  5. The project officer must approve the trademark logo sample before the logo user can produce and apply the trademark logo to their products and/or service.

4. Termination of use

The logo user will not be allowed to continue to use the trademark logo, if one or more of the following occur:

  1. 1. The logo user no longer operates their business within the Blue Mountains LGA.
  2. The logo user infringes the terms of the Style Guide.
  3. The logo user is no longer a paid-up MTNS MADE member.

ACKNOWLEDGMENT OF NGURRA

The City of the Blue Mountains is located within the Ngurra (Country) of the Dharug and Gundungurra peoples. MTNS MADE recognises that Dharug and Gundungurra Traditional Owners have a continuous and deep connection to their Country and that this is of great cultural significance to Aboriginal people, both locally and in the region. For Dharug and Gundungurra People, Ngurra takes in everything within the physical, cultural and spiritual landscape – landforms, waters, air, trees, rocks, plants, animals, foods, medicines, minerals, stories and special places. It includes cultural practice, kinship, knowledge, songs, stories and art, as well as spiritual beings, and people: past, present and future. Blue Mountains City Council pays respect to Elders past and present while recognising the strength, capacity and resilience of past and present Aboriginal and Torres Strait Islander people in the Blue Mountains region.
